Frequently Asked Questions

Please note: mechanical, gas piping, and oil burner permits are handled by Fire Administration.  Please do not submit a building permit application for these types of permits.  Any questions, please call Derry Fire Administration at (603) 432-6751.  

Decks - setback requirements are 15 feet from the side and rear of your property lines and 35 feet from the front of your property line.

Fences - there are no regulations related to fencing.  There is no permit needed.  The fence can be installed up to the property line.  However, we recommend that you set your fence inside your property boundary at least 2 feet so you can maintain your fence and lawn without trespassing on your neighbor's property.

Gazebos - a permit is required, setback requirements are 15 feet from the side and rear of your property lines and 35 feet from the front of your property line. 

Pergolas - no permit is needed but you must adhere to the setback requirements of 15' from the side and rear of your property lines and 35 feet from the front of your property line. 

Plot Plans - a plot plan is a type of architectural drawing that shows a piece of property and all of the essential structures and features. There are several features included on a plot plan, which includes all the buildings, decks, porches, sheds, pools, and other landscape features, as well as the boundaries, set backs, and rights of way of the property.  Sometimes our office has a copy of a plot plan in the property file.  Often times, we do not.  If a plot plan is available, we can scan you a copy and email it to you.  Another option is using a septic design, however, septic designs are not accurate depictions of property lines.  Please call us at (603) 432-6148 if you would like us to check if we have a plot plan or septic design on file.  If neither option exists, you may need to hire a licensed land surveyor to obtain your property/boundary lines.  To help you, please see the attached examples of Plot Plans.  

Roof Shingles - no permit is required if you are only replacing roof shingles.  If you are changing the roof pitch or making other structural changes to a roof, then a building permit is required.  

Sheds - setback requirements are 15 feet from the side and rear of your property lines and 35 feet from the front of your property line.

No permit is required for a temporary sign, such as signs advertising barn and yard sales, and auction signs, if the sign is no more than six square feet in size and is posted for a period not to exceed seven (7) days. 

Solar Array System - complete the solar array system application.  A separate electrical permit is also required.  

Swimming Pools - above ground and in-ground swimming pools - setback requirements of 15 feet from the side and rear of your property lines and 35 feet from the front of your property line.  A building permit is required as well as a separate electrical permit.  In-ground Swimming Pools shall not be located within 35 feet down-slope of a bed (septic) or within 10 feet in any direction of a bed.

Storable Swimming Pools - no permit is needed but you must adhere to the setback requirements of 15 feet from the side and rear of your property lines and 35 feet from the front of your property line.  You may need to obtain an electrical permit. 

Tiny Houses are not allowed in Derry due to the state building code.  The room sizes do not meet the state building code.

Windows - no permit is needed for replacement windows.  However, if you are adding or changing window sizes, then a building permit is required.  When applying for the permit, you will need to choose residential addition and renovations from the drop down box.  

Inspections are not required for the following:

Test pits do not have to be observed.

Wood burning/pellet stoves do not need to be inspected.  Follow manufacturer installation instructions.
